LICENSE AGREEMENT
This is a legal and binding agreement between the end-user customer (“Customer”) and Roboris Srl (“Roboris”). BY INSTALLING, RUNNING, OR UTILIZING IN ANY WAY THE “Eureka3X” software, THE CUSTOMER AGREES TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
ACCEPTANCE OF TERMS
The Customer agrees to the terms of this Agreement by clicking “I agree” or a similar button during the installation process of the Eureka3X software. If the Customer does not agree to the terms, the installation process will not proceed, and the Customer may not use the software. If any part of the agreement is deemed unenforceable, the rest remains in effect.
GRANT OF LICENSE
Roboris hereby grants to the Customer a non-transferable and non-exclusive license to use the Roboris Eureka Free3X SOFTWARE product acquired with this License on any single computer, provided the Eureka3X software is in use on only one computer at any time. For the purposes of this Agreement, a “single computer" includes virtual machines or cloud-based instances. The Eureka3X software is considered “in use” when it is loaded into any form of memory, whether temporary or permanent (such as RAM, CD-ROM, hard disk) of the single computer.
The Eureka3X software may be installed on a network server for use on an internal network at the same site, provided that the Customer has acquired a license for every single computer on which the Eureka3X software is installed (either in memory or hard disk). Network floating Licenses are available only through Roboris Srl and/or authorized resellers. A single Eureka3X software license may not be used to share the Eureka3X software on more than one computer.
COMPLIANCE WITH IMPORT AND EXPORT LAWS
All users agree to comply with all applicable import and export control laws and regulations, including those of the United Nations, the European Union, Italy, and any other country in which the Customer accesses or uses the Eureka3X software. Specifically, the Customer acknowledges and agrees that the Eureka 3X software, including any related technology, technical data, or services, may not be exported, re-exported, transferred, or accessed in violation of such laws, including but not limited to:
1. Prohibited Destinations: The Eureka3X software may not be exported or re-exported to countries, entities, or individuals that are subject to export restrictions or sanctions, including embargoed countries as designated by the United Nations, European Union, United States, or other relevant authorities.
2. Prohibited Uses: The Customer agrees not to use, transfer, or allow the use of the Eureka3X software in activities involving weapons of mass destruction, including but not limited to:
- • The design, development, production, or use of nuclear, chemical, or biological weapons.
- • The development or production of missile technology; or
- • Any other activities are prohibited by applicable laws and regulations.
3. End-User Restrictions: The Customer warrants that they are not:
- • Listed on any government-issued lists of prohibited or restricted parties, such as the U.S. Department of Commerce’s Denied Persons List or Entity List, or similar lists maintained by other jurisdictions; or
- • Acting on behalf of or transferring the software to any such listed party.
4. Export Licenses: If the export, re-export, or use of the Eureka3X software requires an export license or authorization, the Customer agrees to obtain such a license or authorization at their own expense and provide proof of compliance upon request by Roboris.
5. Notification of Violations: The Customer agrees to notify Roboris immediately if they become aware of any violations of applicable import or export control laws or regulations related to the use or transfer of the Eureka3X software.
By accepting this Agreement, the Customer confirms that they have reviewed and understood the applicable import and export control laws and agree to comply with all such regulations. Any breach of this section shall constitute a material breach of this Agreement, and Roboris reserves the right to terminate the license immediately and pursue legal remedies as permitted by law.
EUREKA SYSTEM REQUIREMENTS

• Dedicated gaming video card (e.g., GeForce GTX 1660 or RTX 3060; other GeForce GTX or RTX cards should be fine), NOT necessarily integrated. Nvidia or Radeon cards are fine if they are dedicated.

• 8GB of RAM
• Dedicated GTX or Radeon video card with at least 2GB of dedicated RAM that supports the latest driver updates.

Performance Disclaimer: Eureka cannot guarantee the performance or proper functionality of the software on systems that do not meet or exceed the recommended system requirements. Users are advised to ensure compliance with these requirements to achieve optimal performance. Failure to meet the minimum requirements may result in limited functionality, software instability, or other performance issues for which Roboris assumes no responsibility.
APPROVED MACHINE CONFIGURATIONS
Free use of the Eureka3X software is allowed only with Machine Configurations that have been approved by Roboris or created by a Roboris Machine Configuration Authoring Tool. Approved configurations are listed and maintained by Roboris. Customers can verify approved configurations via Roboris’ official resources or by contacting support.
Editing, tampering, or modifying either Machine Configurations or Eureka3X software for use with unauthorized Machine Configurations is strictly prohibited and will be prosecuted as “Piracy” under local laws and the jurisdiction of the offense.
INTELLECTUAL PROPERTY
The Eureka3X software, including user documentation and related material, is the exclusive property of Roboris. The Customer acquires no title, right, or interest in Eureka3X software other than the license rights granted herein. The Customer may not:
- Copy, reproduce, or distribute the user documentation or related materials accompanying the Eureka3X software.
- Remove any trademark, trade name, copyright notice, or any other proprietary notices from the Eureka3X software.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Eureka3X software, in whole or in part, except as explicitly permitted by applicable law. This prohibition extends to any effort to recreate or develop software with similar functionality using reverse engineering techniques.
WARRANTY DISCLAIMER
Roboris provides the Eureka3X software WITHOUT EXPRESSED OR IMPLIED WARRANTY. No liability is assumed nor accepted for damage or delay of production equipment or processes. Roboris DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Standard warranty conditions exist for all other Roboris products separate and distinct from Eureka3X software.
LIMITATION OF LIABILITY
Roboris and its suppliers shall not be held responsible for any damages, direct or indirect, that arise from the use of the Eureka3X software. The maximum liability of Roboris shall be limited to the price paid by the Customer for the Eureka3X software. Since the “Eureka Free 3 Axis G-Code Simulation" is provided free of charge, no compensation or refund is available.
Liability for damages arising from gross negligence, intentional misconduct, or violations of applicable laws may not be excluded under certain jurisdictions.
SECURITY
The Eureka3X software is provided solely for the Customer’s use. The Customer should take all reasonable precautions to ensure that the Eureka3X software is not made available to any third parties without written permission from Roboris.
The Eureka3X software includes a compliance intelligence mechanism for security and reporting purposes (“SECURITY MECHANISM”) that automatically collects and transmits data regarding the installation and use of the Eureka3X software to Roboris to verify compliance, identify unauthorized use, and enforce intellectual property rights. Additionally, the SECURITY MECHANISM may collect statistical data related to software usage. This statistical data is used exclusively by Roboris to improve the functionality and performance of the Eureka3X software. Data collection complies with Roboris’ privacy policy, which can be reviewed at https://www.roboris.it/en/privacy.
TRANSFER
The license is non-transferable by sale, leasing, sublicensing, loan, or any other means to a third party without the express written permission of Roboris.
UPDATES AND UPGRADES
If the Eureka3X software is an update to another product, the Customer may use the Eureka3X software solely in conjunction with said product and cannot separate it for use on another computer. Updates are optional unless explicitly required by Roboris for continued use of the software.
FEEDBACK
The Customer may be asked by Roboris to provide comments, suggestions, input, ideas, data, or other information in connection with the use of the Eureka3X software (collectively, “Feedback”). Roboris shall have the right to retain and use such Feedback in current or future products or services without additional compensation to the Customer. To the extent such Feedback is protectable under intellectual property laws, the Customer agrees to cooperate with Roboris as needed to obtain such protection, and the Customer agrees to assign all rights to such Feedback to Roboris.
SUPPORT AND ADDITIONAL SERVICES
Support and training for the Eureka3X software are available at an additional cost. The scope of these services, including technical assistance, training programs, and any customization, will be defined through specific service agreements. Customers should contact Roboris to obtain a quote tailored to their needs.
UNILATERAL AMENDMENT
Roboris reserves the right to amend the terms of this Agreement, including pricing for related services, unilaterally. Any such amendments will be communicated to the Customer with reasonable notice. The Customer may accept or reject the new terms. If the Customer does not accept the new terms, the license will be terminated.
INDEMNIFICATION
The Customer agrees to indemnify, defend, and hold harmless Roboris, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with:
1. The improper use of the Eureka3X software by the Customer;
2. Violations of this Agreement by the Customer;
3. The use of the Eureka3X software in violation of any applicable laws or regulations; or
4. Claims arising from any modifications made by the Customer to the Eureka3X software or Machine Configurations without approval from Roboris.
5. All penalties from the unauthorized distribution or sale of Eureka3X software by any party.
TERMINATION OF THE LICENSE
The license granted hereunder may be revoked and terminated by Roboris with written notice to the Customer if:
1. The Customer breaches any provisions of this Agreement.
2. The Customer fails to make any due payments related to the Eureka3X software, such as for authorized Roboris Machine Configurations, training, or support services.
Upon termination, the Customer shall cease all use of the Eureka3X software, delete all copies, and forfeit any entitlement to updates or upgrades. Roboris reserves the right to take legal action to recover damages incurred.
GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement is governed by the laws of Italy. Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in Italy, unless otherwise required by applicable laws.
ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties regarding the Eureka3X software. By installing or using the Eureka3X software, the Customer acknowledges and agrees to these terms.
Roboris Srl reserves the right to modify this Agreement with notice to users as required by applicable law.
